Legal Question in Real Estate Law in New York

Quad

Recently, our neighbors kids have been riding their Quad up and down our road. The road is a cul-de-sac. My wife and I live on top and these kids live on the bottom. They were turning around on our property. We told them not to do that because they could get hurt and they did not belong on our property. We also found them playing on our property when we were not home. They also tried to play there when we were home. We told then they could not play there and advised their parents of what was going on. They then returned and did the same thing. My wife and I went down and talked to their ''father'' (We think it was their father. This was the person watching them.) again and he said he would put the Quad away. He didn't and they continued to go up and down the road, not turning around in our driveway. We went out and when we came back one of their kids was turning around in our driveway. We told the girl to not turn around and that we talked to her father about it earlier. She said I can't even turn around and we said no. We called the police for advice but did not file a report. My question is this: Legally what can we do? Can we sue them for harassment if they don't stop? We also have 2 no trespassing signs clearly posted.

Re: Quad

You should send them a letter, or maybe have an attorney do so. In addition to the nuisance and trespassing, there are safety and liability issues that you should be concerned about.

Re: Quad

Technically, they are trespassing. It all depends on how far you want to go to pursue it with the sheriff. Maybe a written letter to the "family" before anything furher?

Good Luck
