Legal Question in Real Estate Law in New York
Questioned Indenture do we have any recourse?
I am taking a long shot here but I can't give up hope without trying. My father's First-Cousin passed away in Saratoga County,NY in 1991.This man was never married and had no children and he was also an only child. His only relatives had been his 3 First-Cousins,my father and my 2 uncles. He outlived all 3 of them,so when he died his only living relatives were the children of his First-Cousins..9 of us altogether. He owned a 400 acre farm with a newly built log house, and had quite a large sum of money in the bank. After his death we discovered that the local sherriff had an Indenture signing over our cousin's land and bank accounts, literally every single thing he owned,to the local sherriff. The signature on the indenture was very questionable, first name was shaky and the last name slanted diagonally up away from the line across the page,He was a heavy drinker. We immediately consulted a lawyer, but stupidly it was a lawyer in that county who told us that the only people who could contest the indenture were people who shared a biological grandparent.I have recently been told that this was incorrect.Do we have any legal recourse against this man or has the statute of limitations on this passed?I do realize it has been quite a long time.

You may, but there is not enough documentation in your post, who by virtue of this bulletin board system there cannot be.
I'd be pleased to provide a free telephone consulation if you'd like to discuss.
Good Luck
