Legal Question in Real Estate Law in New York
Can a quitclaim deed be used to transfer a small portion of a complete property, or is it used to transfer a complete property (with occassional exclusions?) My neighbor and I want to adjust our common property lines by me giving him a piece 65x90 sq. feet and he giving me a slice of land 6x150 sq. feet.
There are no liens, or any kind of 3rd party interest in the land. We were ready to complete 2 quitclaim deed forms when he was told by a knowledgable friend that a quitclaim deed is generally used to transfer the bulk (or complete) piece of property, not a small section of it.
Now we are both concerned as to whether the quitclaim deeds can be used to swap the 2 small portions of land. (To even out our property lines.)

Quitclaim deeds are perfectly good for transferring title. However, before closing the deal, I would run a title search against both properties and make sure there are no surprises lurking about.
