Legal Question in Real Estate Law in New York

Real Estate Contract with Agent

In New York 11235

I entered into a contract with a real estate agent that misrepresented the contract I was signing. He said it was NOT an exclusive right to sell and said he would run the listing through the MLS for all agents to submit offers. He also said he would handle it for 4 month time period.

He never left a copy of the contract and did not fill it out in my presence before signing.

Today (24 hours later) I asked for a copy and it says he has exclusive rights for 6 months.

I know. I was wrong.

Ok so how many days do I have legally to break this agreement with the agent?

Please respond to [email protected]

Thank you

Re: Real Estate Contract with Agent

You are responsible for the terms of the contract that you signed. If it was altered subsequent to your signing it, then you are not bound by the changes/additions and you may have a cause of action against the broker. Also, you may have a right to rescind or terminate the agreement, but I need to see it immediately to tell you whether this is the case. If the broker acted improperly, there are several avenues of recourse available. Feel free to call me at 212-367-9167 - I do not charge a fee for the intial consultation.
