Legal Question in Real Estate Law in New York

real estate deed

This is my second marriage and we both have children from our former marriage. I am very ill, and want to know if my half of the house can be transferred to my children. Does my husband have to agree to this. i put alot of money and heart into the house and donot want his children, or another wife to have my share when I die.

Unless your children are adults, you should not be placing title of the house in the children's name. The house - or a percentage of the house - should be placed in a trust. Under the terms of the trust the house would be deeded to the children when they become adults - or any other time at your discretion.
