Legal Question in Real Estate Law in New York

Real Estate Property

''Our dad is over 80 yrs and had a piece of real estate property in his name for over 30yrs. He has 6 children and unfortunately, one of the siblings coerced our dad into signing the property over to her. This is not want our dad wanted! To make a long story short, we recently learned that the property could be sold. We (siblings) and dad are trying to seek legal assistance in determining what options he has. The property deed is in the one sibling name. All my dad recalls is that he signed a lot of papers. Unsure what we can do, if anything...Thanks

Re: Real Estate Property

You would have to commence an action for fraud and for a constructive trust against the house. You would also have to file a lis pendence against the house so the sibling will not sell the property pending the outcome of the litigation.
