Legal Question in Real Estate Law in New York

Real Estate

My retired parents sold a portion of their property to a developer. The developer promised to give them a new driveway and garage. The developers just completed construction on a new house on the propery that my parents sold to them. Tomorrow 11/2 they will be going to closing with the new buyers. The developers stated that they have no intention to honor the original agreement stipulated in the original contract ( re: driveway and garage). What can we do? The property is in Queens, NY.

Re: Real Estate

They need to file suit ASAP for specific performance (build the garage) and/or breach of contract (they give $$ for value of same).

Hopefully the contract was signed for by and individual and not on behalf of a corporation.

Re: Real Estate

Most likely as Ms. Feldman indicates you would need to initiate a suit based in breach of contract and for specific performance. Do you still have the contract? This area of law is our specialty, however, we would need some more information before making a complete and proper determination. You are welcome to contact us for a free consultation.
