Legal Question in Real Estate Law in New York

I am selling my home. I live near a huge industrail building. In the winter the heating system of this large building emits a humming vibration that disturbs our sleep. Do i have to disclose this situation to a would be buyer? Or is there any recourse to this problem. I have a job offer out of state and i have to move quickly.

Generally, the answer is no. NY Real Property Law �462 (Property Condition Disclosure Statement) lists items that may be disclosed to a seller. However, outside noise is not one of the items that should be disclosed. Furthermore, you may pay $500 in lieu of delivering a disclosure statement.
