Real estate services provided from abroad regarding property located abroad
Hi,
We are planning to help US citizens to buy or sell property (and related services) that is located abroad. We plan to do that through representatives (franchises) in each state (starting from NY State). We are authorized brokers in our country and we are planning in operating directly from there. Do our representatives in NY have to be brokers and can we resolve any differences between the end customer and our company (the parties in the contract)in the courts in our country? Should we insure our representatives against liabilities that arise from recommending us as a business partner to their customers?

It would be wise to have your representatives insured to cover you against lawsuits. Also, if you plan on doing certain types of sales, such as time share arrangements, you may have to be registered in the State. Signature on contracts may need a power of attorney and you would need to look at the jurisdiction where the property exists to see what the requirements are to have an enforceable agreement.
