Am going to do real estate tranactions out of state do I hire an attorney in that same state am going to do business in.

Yes. You'll need an attorney licensed in the state where the real estate is located. In some states, you will need a certificate of authority to transact business in that state.

I agree with Dave on both scores - using a local attorney and registering the business. While in many states a title company can handle the real estate closing without an attorney, they cannot assist you if there is a contract problem, or with the business aspects.
