Legal Question in Real Estate Law in New York
Real Estate/Basement Apt.
My grandparents will be moving into my parents new home but they are not going to sell their current home. Their current home is a 5 family. Is it illegal to make the basement an apartment for myself since no rent is being collected?

Re: Real Estate/Basement Apt.
If the basement apartment can be legalized and the Certificate fo Occupancy (C of O) upraded you can occupy the apartment.
You can check the C of O and see if the basement was ever approved as an apartment. For deeper inquiry you can contact our office.

Illegal is illegal, especially in a multiple dwelling. Rent is not the issue.
