Legal Question in Real Estate Law in New York
Recently bought a home. During the inspection, a few major issues came up that needed to be fixed. we got 2 quotes, and sellers were not happy, they got their own quote from a friend which was SUBSTANTIALLY less. We negotiated and the sellers put money in escrow account for contractor to do the work for us. So, we followed through with the purchase of the home based on the fact that the work would be paid for. Contractor has now refused to do the work after signing notarized docs. Money in escrow is in his name. Is it possible to file a suit against the contractor for the work needing to be done as well as purchase price of the home as the home would not have been purchased without this contingency?
1 Answer from Attorneys
You might be able to sue the contractor for breach of contract but not for the purchase price of the house. You would sue for the real cost of doing the repairs. And the contractor's name should not be on the escrow. Did you ave your own attorney? You may have a malpractice claim.
