Legal Question in Real Estate Law in New York

I recently rented my condo with a 3-year lease. I just got divorsed and now want to move back ito my condo. Can I evict the tenant even though they signed a 3-year lease and if yes, what is the penalty to me?

No. All parties must honor the lease. The only way you may re-take possession (and assuming the tenant is honoring the lease by making payment) is through the consent of the tenant.
