Legal Question in Real Estate Law in New York

Recouping the loss on an interupted inspection

Do I have any legal footing to recoup the price of an inspection if

the seller of the property agreed to it and then on the day of that

inspection stops it and kicks everyone out, because she felt that an

hour and a half is too long to take? It was useless because it

wasn't completed.

Re: Recouping the loss on an interupted inspection

If you have a signed contract of sale allowing you to perform a home inspection, the refusal would constitute a breach of contract by the seller. You should be able to complete the inspection or get your money back, as well as terminate the contract if the seller refuses.

Nope...not unless you were already in contract and there was an agreement.

BUT...check with your broker and the binder..see what thebinder says and use it to force YOUR broker to get the $ or the inspection done,

Good Luck
