Legal Question in Real Estate Law in New York

Rent payment

I have a tenant who moved in on Feb 1, 2001 She is consistantly late with the rent. I approached her yesterday and she informed me that legally she has up until the tenth of the month to pay her rent. I have never heard of this and would like to know if this is true. Could you please let me know what the rent payment laws are? Thank you

If the lease states that there is a ten day grace period before rent is due then the tenant can pay on the tenth. However in a normal lease rent is due on the first of the month and if not paid within five days after the first ten percent late charges are then assessed. Read the lease to see which condition applies.
