Legal Question in Real Estate Law in New York

i was renting in long beach ny when the apartment was broken into, and the front window came off the hinges in the process, the landlord happens to be the suspect of this investigation, but that aside, the lease is up, and he is claiming he will not return the deposit because of the broken window even though we have a police report stating this happened at that time. can he do this

I think you would have a good basis to sue for your money back if the window was broken by a thief, however, I would need to review your lease to be sure.
