Legal Question in Real Estate Law in New York
I renting in a non rent controlled, 28 unit building, in Park Slope, Brooklyn. I would like to sublet to a highly qualified friend (excellent credit score, good rental history, and yearly income 70x monthly rent). The landlord wants to raise the rent for the sublet period by 12%, but the lease has no provision for this. I would like to sublet at the actual rent. After requesting consent from the LL, can I proceed with the sublet, irrespective of the answer (as I deem a 'no' to be demonstrably unreasonable), and be legally in the clear simply by meeting all of the obligations that I have under my lease?

It would depend on the language of the lease. If the lease has a clause forbidding you entering into a sublease, the answer would be no.
