Renting Rooms In A Rent Stabilized Apt.

If the tenant of a 3 bdroom apt. rents out 2 rooms to 2 people for $750/ea and the rent for the apt. is $1,500, resulting in the tenant not paying any part of the rent (tenant resides in the apt), is this violating any laws? Utilities were split 3 ways and renters used tenants furniture in apt., etc.

Assuming the apartment is in NYC, it depends on what the lease says and whether or not the apartment is regulated.

If the lease prohibits subleasing, this is improper. If the lease is silent on subleasing, this may have been a good deal for the original tenant.
