can we require our loud neighbours to put down carpeting?

We rent an apartment in Brooklyn, New York. The tenants who live above us are extremely loud and inconsiderate. We have asked them numerous times to take off their shoues when they stomp about in their apartment. We have a small baby who will wake up repeatedly from naps or in the middle of the night because our neighbors make so much noise above us.

We heard that Massachusetts has a law that requires tenants to put down carpeting over a certain percentage of their apartment to muffle some of the noise. This would greatly help. Is there such a rule in New York State???

Most residential leases require that 80% of the floors be covered. I suggest that you inform the landlord of the situation and ask him/her to contact the tenants and request that they comply with the lease and be quieter. You can keep a log of the noise problem and if the situation does not improve, you should seek legal help.
