Legal Question in Real Estate Law in New York

who's responsible?

After a recent rain storm, large branches from a neighbors tree fell onto another neighbors tree. The second tree is directly behind my back yard. Branches, from the second tree, are now pressing precariously on my garage roof. Which neighbor is responsible for removing them and how do I approch them. Thanks

Re: who's responsible?

The direct cause appears to be your adjacent neighbor's tree which is resting on your roof. While caused by his adjacent neighbor's tree, it your neighbor's tree that is creating the problem. I suggest you contact your neighbor and request he remove the branches. He should, in turn, contact his neighbor as that was the primary cause.

In either event, your direct recourse is against your neighbor.
