Legal Question in Real Estate Law in New York
Who is responsible to replace a damaged culvert?
I have a culvert that is damaged and needs to be replaced. It is right at the end of my driveway. I have a map that says that part of the property belongs to the Town. The previous and original homeowners have informed me that the Town Highway Department put the culvert in when they had the home built. The Town has informed me in writing that they are not responsible for this. Is there any law on the books that says who is responsible?
Thank you!

Re: Who is responsible to replace a damaged culvert?
See your survey....see the use and installation....see who benefits from it [Is it your Town? Dutchess County?]...see a laywer.
There are too many unanswerable questions to be able to repond clearly online.
Good Luck
