Who is responsible to replace a damaged culvert?

I have a culvert that is damaged and needs to be replaced. It is right at the end of my driveway. I have a map that says that part of the property belongs to the Town. The previous and original homeowners have informed me that the Town Highway Department put the culvert in when they had the home built. The Town has informed me in writing that they are not responsible for this. Is there any law on the books that says who is responsible?
