Legal Question in Real Estate Law in New York
Rights of landlord
I own a house in the Troy, NY area. Recently attempted to collect unpaid rent from a former tennant. I found his address and submitted the necessary paper work to Troy City Court. They told me the letter came back undeliverable. Then I found another address where he was living and had him served in Watervliet, NY. A different jurisdiction.
He tried to counter sue me. Lo and behold, the address he was counter suing me from is from the original Troy, NY address. So, over I go to Troy City Court again.
They tell me that they can no longer serve him, because they tried once. Are they right to do this when I'm standing in front of the clerk with evidence that the guy lied about his address.
What is my next course of action?
