Rights to Property in case of a divorce
If you are married in the state of New York and the Land and Mortgage are in your Name Only (which mine is) is this still considered community property. The Land Deed and Mortgage are in my name only. The land was acquired with partial inheritance money and after we were married.

NY is not a community property state however, since it was acquired after the marriage it will be considered marital property for purposes of determining equitable distribution between you.
