Roommate problem

I have an abusive roommate I want

to leave at the end of the month who

has both caused damages in the

apartment that will require his

deposit and has broken his promise

to stay for a year (forfeiting his

deposit)... even though I have a new

roommate moving in at the

beginning of next month, he refuses

to leave without his deposit!

He is not on the lease and we had a

verbal agreement as a contract when

he moved in (which he promptly

broke). Does this lack of a formal

contract or lease give me any sort of

control over the situation?

HELP!!!

Actually, depending on how much the deposit was, it gives your roommate a much more difficult time to recover the deposit. The details of this situation are vague, so I would recommend speaking with your landlord to see if they can assist in resolving this problem. If your soon-to-be former roommate is not on the lease, it will be easier to have him removed from the premises once formal notice is given.
