Section 8 recertification

My mother has shared an apartment with her mother for over 10 years with NYC HUD. The section 8 for the apartment was in her mother's name & her mother has recently passed away.After the passing of her mother arrangements were made to have the section 8 changed over into my mother's name but HUD Falied to transfer the documents for section 8 to my mother's name & now she is recieving an eviction notice stating that her section 8 has been terminated because she failed to fill out & return the recertification letter. Please be advised that the recertification letter came her mothers name & section 8 has never been changed over to her. How can she get around being evicted?

If your mother has received the dispossess, she should go to court and get a court date. On the Court date, she needs to bring the paperwork that she has from section 8 and ask the HUD Attorney to write a stipulation and give her time to resolve the payment problem (i.e. four weeks). She should also go the Section 8 office personally and speak with the caseworker.
