Getting the security deposit back from a commercail lease

Our retail store 15 years commercial lease is going to end on Oct.31,06 We are debating if to apply the $24,000 security deposit towards the last two months rent bacase our landlord claims that when he bought our lease from another company 5 years ago they never received our deposit therefore, he doesn't need to give it back to us. On our original lease it does state our deposit and we never had any dispute with our previous landlord for loosing the deposit. we don't want to loose that kind of moeny, Please advise! Thanks.

An attorney should review the lease, payment of security deposit and other details if you anticipate a problem. The attorney might then write to the landlord and ask him to acknowledge your position and to respond, stating that the rent is being held back due to his threatened taking of your security deposit.
