Legal Question in Real Estate Law in New York

security deposit

I lived with 2 other roomates, who were both on the lease. When we moved out I received the security deposit back from Management. Do I have the right to withold around $200 to one roomate for damages I know she incurred? She already has been complaining to me that she wants the rest of her money, and i think she might sue me, can i withold this money from her since i know she was responsible for it. all 3 of us were on the lease but i was the one who gave in the check for the security deposit which is why i received it back in my name.

Re: security deposit

You do not say if the alleged damages were deducted from the security deposit or had to be otherwise paid by you? If so, you are entitled to reimbursement, the question being how to allocate the reimbursement. Also, if you solely provided the security deposit and were not reimbused each one's share, why is anyone else entitled to share in its return? This is a response to an Internet question and the reply is not intended to be legal advice or as creating an attorney-client relationship. Omitted facts may produce a different response.
