Security deposit return

Landlord company refuses to return security deposit. It says that the deposit was applied for major capital improvement of the building (MCI). I moved out on February 1st 2009, but landlord wants to collect the rent increase until 2010. I was paying rent with increased amount because of MCI through 2008. Since I moved out and landlord will probably increase rent to collect money for MCI from the next tenant, I'd like to know if landlord's refusal to return the security deposit is legal.

If you breached the lease agreement by vacating the space early, the landlord is entitled to retain the security deposit.
