Is the Seller or Broker liable?

A few months ago I went into contract for a ''3 family� building in Brooklyn, NY. When the title search came back the CFO said it was a legal 2 family. The sellers and I cannot agree on a new price, so basically I am left with over $3,500 in out of pocket expenses and nothing to show for it. What options do I have to get reimbursed, and is the seller or real estate broker liable for misrepresenting the number of units in the building?

Is the Seller may be liable?

The contract may call for the seller to legalize the property if a title search reveals a prblem. The contract must be reviewed by an attorney.

If the seller bought the house and knew it was a legal two at the they purchased it, then they may have defrauded you when they sold it as a three family.
