Legal Question in Real Estate Law in New York

Seller Rights

My buyer signed contract in early july and we still have not closed.

Their attorney had my attorney RUSH me out of my place for a 9/15 closing date which fell through and we still have not set a date. What are my rights? I am no renting and paying a mortgage. Can i keep Downpayment (or at least 1/2) and back out?

Re: Seller Rights

There are not enough facts presented. What does the contract provide as to a closing date? Why was the original date not kept? What, if anything, still needs to be done? Did your attorney send a Time of the Essence letter, making a closing date madatory?
