Legal Question in Real Estate Law in New York

Sellers refuse to sign replacement deed.

Purchased house 1984, deed was in lawyer's office to be registered, lawyer sent to federal prison, wife burned all papers. Have land contract, new lawyer drew up new deed 7 mos. ago, sent to the sellers to sign, they will not respond. He says there's nothing else he can do. What recourse do I have?

You may need to get a court order directing the Seller to sign a new Deed, or acting as a confirmation of the purchase. Reference your title insurance policy as part of the pleadings to confirm the purchase. You may have a claim for damages against your former lawyer for the costs you will incur to get this corrected, but collecting it may be another story since he is in jail.
