Legal Question in Real Estate Law in New York

selling home/non marital breakup

I have been living with my boyfriend for two years. Last year we built a home

together, and now I realize it was a huge mistake. I would like to sell it, but I

know he's going to demand extra money from the sale for various

''improvements'' that we both paid for. The home was built for 168,000 but is

assessed for $260,000. I know I need a lawyer, but what are my rights as a

co-owner of a home? And how do I get out of this without it getting truly

nasty, as I don't want that to happen. We own the land and the home on

paper equally. Thank you

It depends how you are listed on the deed to the property. If you are down as tenants in common, or joint tenants, it is presumed you are 50-50 owners and can equally disburse the proceeds at closing. However, if he raises additional issues pertaining to contribution towards expenses, you will have to sort through that.
