If you sign a 3 year least stating that you will pay a 3% increase each year and the landlord does not enforce it until after the fact after a year which you sent checks and the landlord cashed them, are you liable for back rent

yes, but not to evict (rent has to be "fresh" to base an eviction on nonpayment), just to collect the rent.
