Legal Question in Real Estate Law in New York

Can I sue my Real Estate Broker? i moved in May to an Apt. that despite being in the suburbs has no parking any where at night, except the few spots in front of our building that all get taken up.\n\nNot the broker nor the landlord told me anything about this when they both showed me the place. I\'ve since racked up hundreds in tickets and now I\'m going to move because this has the potential of being really expensive. Further, when I told my landlord he said I could park in the basement garage but it costs $200 a month; again no mention of this $200 parking at the onset by either broker or landlord.\n\nI think I\'m ready to move but I want my deposit back and i want my broker fee back. Both are $1200.

Unless the broker misrepresented to you that there was plenty of parking available and she/he knew there wasn't or should have known...you have no claim against her/him.

If parking was a primary concern of yours it was up to you to investigate/inquire about it.
