Tenant cuts tree branches
My tenant who has occupied a rental unit for about 2 years has cut the branches up to about 4 feet from the ground on a 40 foot spruce tree. He did not ask permission to do this. The tree is located in the back yard and is not in the way of anything (driveway, etc.). He cut them just on one side so needless to say it now looks awful. Can I get compensation from him for the damage he has done to the tree?

Having said that much, I expect you can get damages from him, assuming the tree was in good condition beforehand, and assuming you own the tree and the property. Look carefully at your lease with him, or if no lease, look at a blank form release which is similar to what an oral lease really is. You will also need at least one or two experts to tell you what your damage is. Then make your decision about suing, withholding security, evicting, or other potential remedies.
As I mentioned before, this is something that you will want to take up with a lawyer of your own selection, either in your state or area or in a place where some of the pertinent events occurred.
