Legal Question in Real Estate Law in New York

Tenant is not moving out!!!!!

I am renting out my house. Original contract for occupancy was for 2 years which both parties agreed back in 1998. We never officially renewed the contract but tenent has been living in the premise ever since. In august of 2002 i send the mail certified (and also called him personally) asking him to move out. He said he would do so. In about a month later certified mail was returned saying that the recipent denied the letter. I went to the house myself and got the letter signed by the tenent saying he would move out of the house by dec 15, 2002.

Question is, what can i do if he doesn't honor the letter he signed? How soon can i force him to move out of my house? What are the legal steps do i need to take?

You have to commence a landlord-tenant action seeking judgment of possession and warrant of eviction. The tenant is a holdover tenant.
