Getting Tenant out for non payment

I have a tenant who is now 2 months past due on his rent. We have $7,800.00 as security but the contact saids that he could not live out his security. He says he doenst have money to pay his rent. Can we garnish his salary? If we bring him to court can we make him pay all our lawyer fees. What are our rights to get him out. Can we change the locks on the house so that he cant get in? If we have a contract that is signed by him and he doesnt live up to his agreement do we have any re-course. Any help would be appreciated. The house is located in Nassau

DO NOT CHANGE THE LOCKS!!!! It is illegal and will only hinder your cause rather than help it. You need to have a summary proceeding for eviction filed in the housing Court in your county. There are very specific guidelines that must be followed, as such it is highly reccomended that you retain an attorney to handle such a matter for you.
