Legal Question in Real Estate Law in New York

tenants rights

My landlord is evicting me for smoking cigarettes in my apartment. There is nothing in my lease forbidding smoking. There is also an older guy who has something against me for some reason, and I feel he is making false statements to the landlord. I want to fight this.

Re: tenants rights

For an eviction you must receive a Notice of Petition and Petition. The Notice of Petition will have a Court date. The Petition lists the reason why you are being evicted.

You will have the opportunity to speak to the Court and oppose the petition on the return date.

I think this is an issue that may be reasonably negotiated. An air filter and an air freshener may help alleviate the problem.
