Legal Question in Real Estate Law in New York
Is there such a thing as a legal basement apt in Brookhaven Township, NY?
A friend told me this:
''its primarily a safety issue and been that way for decades.every home,apt house,meeting place has a certificate of occupancy that says very clearly how many people can legally-and safely-occupy the place. i dont know the formulas but its not like its 1000 sq ft per family.
basements usually have no or very small windows and rarely do they have an outside door.most lack smoke alarms and fire extinguishers.there have been countless instances of people dying in basement apt fires because they had no way out/
trust me,my 2 friends got booted out after 15 years even though their apartments were only 3 steps down from the street and never had problems,the housing codes in nyc and li FORBID basement apts.under any circumstance.and u cant bring them up to code. ''
So what's the real story? Is it possible to have a LEGAL basement apt in Brookhaven town or Suffolk County?

A legal apartment in a house has to have a certificate of occupancy allowing the building to be a 2 family house. Although all basements are not the same, generally, a basement is not livable space.
