Legal Question in Real Estate Law in New York

i totalled my car after i hit a power pole and was then takin to the hospital i was told to pick up the accident report at a later date but when i picked up the accident report it didnt have any information on where my car was takin so i can sue the officer that wrote the report for not giving me proper paperwork?

I am not sure I understand your question. You want to sue the officer for not telling you the location of your car?

On the accident report there will be a box that states who towed the vehicle and to where. It is about 3/4 of the way down on the left below the information to the car. Did he or she leave that section blank? Check this box first; if it is blank, were you able to ascertain the location of the car by calling the police precinct?

Under the VTL, every police officer to whom an accident resulting in injury to a person is reported, shall immediately investigate the facts, or cause the same to be investigated and shall report to the DMV (via police report). He or she also has a duty to request the operators to exchange information when they are physically capable.

As for your question, the real issue is did the police officer, by his actions, cause you any loss or injury. If the answer is a mere inconvenience than the answer is probably no you have colorable suit against the police officer.

If you more information that is relevant please let me know, perhaps I am missing something.
