Legal Question in Real Estate Law in New York

Tree fell on my house last night. It was extremely windy. Tree is on my neighbors lot. Do I have to pay for removal?

Unless you want the tree to remain on your house, the answer would be yes. Your neighbor is not responsible for damages from the fallen tree unless you are able to demonstrate that he had notice that the tree was rotted or about to fall and that he failed to take any reasonable action based on the notice.
