Legal Question in Real Estate Law in New York

tree pruning

My neighbors fruit baring mulberry trees over hang into my backyard. In about June the fruit drops into my yard, filling it with berries and making my yard unuesable for the better part of two months. my childern cannot use land that I pay very high taxes for. I would trim it myself, but why should I incur the cost. I have sent a letter (certified)to my neighbor with no response. My neighbor will not prune the trees, thus we do not get along. It is now April, Do I have legal recourse?

Re: tree pruning

You can prune the tree at your expense..being careful to prune only that which is on your side and taking care not to damage the entire tree..or you cansue him in nusiance but that cannot be done in small claims court and will cost you more than just pruning the tree.
