Legal Question in Real Estate Law in New York

unreturned security deposit

I moved out over 30 days ago and have not yet recived a

note of itemized deductions or my security deposit.

My security deposit (which was 2 mo. rent) might be

being withheld because I only gave 2 weeks notice for

not renewing my lease. I didn't think this was going to

be a problem because the landlord never offered me a

renewal and there is nothing in the lease that says I

have to give notice in a certain amo. of time.

Do I have a case to win back my security deposit, or is

there some NY law that states no matter what the lease

says, or doesn't say in this case, I have to give 30 days

notice?

Thanks,

Natalie

Re: unreturned security deposit

This problem occurs far too frequently. You are entitled to the return of your security deposit, together with interest on the deposit.
