Legal Question in Real Estate Law in New York

VA is asking for a mainteance agreement for the house we are buying on a private road.

How can we get around this as their is no agreement between the other home owners.

Who owns the road? Are you an easement holder, or is this an "easement of necessity?"

The lawyer handling the purchase should be dealing with this.
