Legal Question in Real Estate Law in New York

Void/Voidable Deeds

I would like to know the difference between a void deed to real property and a voidable deed.

Is a deed executed by a grantor who lacked mental capacity at tht time of execution void of voidable??

Voidable. The Court must determine whether the "deed" is to be voided.

A "void" deed is Void on it's face.
