Legal Question in Real Estate Law in New York
Wanting Money not professional
I filled out a rental application in NY gave the person a check for the rental she said she had a lease that needed to be filled out she gave me the keys on saturday. monday was a holiday I did not here from her regarding the 1 year lease so Tuesday I called her and she asked if my husband could cash the check I gave her because it was from out of state. I said I would check she said to call her back and leave a message if she was not there. I called her back at 1:00pm and left a message that I decided not to take the apartmentand she could pick up the keys and gave her the address. she never returned the call I stayed in ny for 2 extra days and stop payment on my check. Now she is writing a letter stating that i am responsible for the apartment and a bounce check. She recieved my message but took the check to the bank anyway am I responsible for her taking the check and not responding to my call? I had no address to give her keys back while I was in NY and she never contacted me the 2 extra days I was there. Most legal contracts you have 3 days to cancel but I never signed a lease and gave her notice before she went to the bank.

You are not liable since there is no written lease.
