Legal Question in Real Estate Law in New York
Warranty of Habitibility
My apartment is unlivable during the hours of 8:30 am to 5 PM because of Construction the Owner is doing outside my window. The construction is for beautification purposes to the owner's property. The construction is so loud that any activity - watching tv, studying, talking, or having a phone conversation is impossible. The apartment is shaking all throughout that time period. This has been going on for several months.
Am I entitled to a rent reduction based on the warranty of habitability?
