New York City Rent Stabilization

Hi,

My landlord offered a renewal lease for my rent-stabilized apartment only six weeks prior to the expiration of my current lease. I promptly responded by certified mail, informing landlord that the New York City Rent Stabilization Code stipulates that renewal leases must be offered at least 90 days and not more than 150 days before the expiration of a lease. I also asked for another renewal lease that would take effect within the time period mandated by law, thereby delaying my renewal rent increase. Now, two weeks after I sent that letter, landlord has still not responded.

If I don�t sign the illegal renewal lease, would I risk being evicted?

No. You are exercising your legal right...and correctly too. Your landlord is in violation of the law.

If he tries to evict you, you will answer the eviction with the defense you just outlined. If you use an attorney, ask for attorney fees.
