Legal Question in Sexual Harassment in New York
My boss hit on me at our office post-Christmas party
Following our office Christmas party,
most of our office went to another bar.
My boss asked me if i wanted to go
back to his place with him. He said he
wanted me since a different office party
that was back in 2000 or 2001. I'm not
sure. I sit close to him and I am very
uncomfortable seeing him now. What
can I do?

There are a number of different strategies in a situation like this, and they all depend on a number of factors, e.g. size of the company, company harassment policy. Please call to discuss in more detail, or visit my website for more information. www.bchaolaw.com

There are a few things you can do, but you must be cautious and tread carefully. Of course, you must also ask yourself what you hope to accomplish -- are you looking to get out, be transferred, have your boss fired, get promoted, win a 10M settlement? The first thing you need to do is sit down with an experienced attorney and review the facts of the case to determine if the events in question establish grounds for a favorable lawsuit or settlement.

Unless your position or job was adversly affected because you refused
his advances, you do not actually have
an employment discrimination claim.
You have the start of a hostile work environment situation; if your company has an impartial human resources department, report it.
If you are uncomfortable with that,
you can report to the State, or City
of NY Div. of Human Rights or EEOC
depending on the company size and locale. If you wish to discuss further, contact me.
