Legal Question in Sexual Harassment in New York
employer forgery
In October I filed a complaint to Human Resource complaining of sexual harassment, including a submitted copy of my timesheet in which my manager had destroyed my original, hand wrote new hours worked, cut my signature from a previous time sheet taping it to the new one he created and then faxed/submitted it to human resoure shorting me out of all overtime for the week. This was discovered by a fellow employee. At the end of the investigation HR said they found me not to be in a hostile environment. I now feel a threat of termination from the company. What action should I take?

Re: employer forgery
Your company's HR department does not have the final say on whether or not you've been subjected to a hostile work environment. Depending on the size of your company you may want to consider contacting the EEOC. Your employer is required to keep accurate timekeeping records of your work. Forging the records not only exposes the employer to possible criminal liability, but civil liability too.
